User Agreement

Welcome to ArtShadown. These Terms of Service ("Agreement" or "Terms") govern your access to and use of the ArtShadown website, mobile applications, AI image and video generation tools, rendering APIs, and related services (collectively, the "Services").

By creating an account, logging in, or accessing any part of our platform, you agree to be legally bound by this Agreement. If you do not agree to all terms herein, you must refrain from accessing or using ArtShadown.

1. Digital Age Consent & Account Eligibility

To use ArtShadown, you represent and warrant that you meet the minimum digital age of consent in your region (at least 13 years of age, or higher if required by applicable local law). If you are under 18 years of age, you may use the Services only with the explicit consent and active supervision of a parent or legal guardian who agrees to bound by these Terms.

You are responsible for maintaining the security of your login credentials and for all activities that occur under your account.

2. Nature of Services & AI Machine Limitations

ArtShadown provides algorithmic machine-learning tools that interpret textual prompts and visual reference files to synthesize high-resolution images, 3D artwork, and cinematic video clips. You acknowledge and accept the following inherent characteristics of AI generation:

• Probabilistic Computational Nature: AI models execute complex statistical calculations. Outputs are generated based on mathematical probability algorithms and may occasionally feature visual artifacts, anatomical inaccuracies, or unexpected artistic interpretations.
• Creative & Entertainment Purpose: All rendered outputs are provided exclusively for artistic creation, self-expression, graphic design, and entertainment. They do not constitute official certified photography, legal evidence, or professional architectural/technical blueprints.
• No Guarantee of Uniqueness: Due to the open nature of prompts, similar prompts submitted by different users may produce aesthetically comparable visual results.

3. Subscription Tiers, Credits & Refund Policies

Processing high-resolution AI visual rendering and video frame synthesis demands intensive real-time GPU cluster hardware resources. Access to premium generation features operates via In-App Credits or recurring Subscription plans:

• Payment Channels: Purchases are billed through official platform commerce portals, including Apple App Store, Google Play Store, or certified third-party merchant processors.
• Immediate Server Resource Expenditure: Generative computations occur immediately upon submitting a prompt or triggering a video rendering sequence. Because GPU hardware capacity is consumed instantly, purchased credits and active subscription fees are non-refundable once rendering services have been initiated.
• Billing Inquiries & Disputes: Financial refund claims or billing disputes must be submitted directly to the corresponding platform (Apple or Google) in accordance with their respective app marketplace refund guidelines.
• Subscription Renewal: Subscriptions renew automatically at the end of each billing cycle unless canceled prior to the renewal date through your account settings or store portal.

4. Intellectual Property & Content Ownership

We respect creator ownership and intellectual rights:

• Your Inputs & Source Files: You retain all ownership rights to the prompts, raw photos, and creative directives you submit to the platform.
• Generated Outputs Ownership: Subject to your compliance with these Terms, you hold all rights, title, and interest in and to the images and video clips generated by ArtShadown under your account, including rights for commercial licensing according to your plan tier.
• Platform Operating License: You grant ArtShadown a limited, worldwide, royalty-free, non-exclusive license to process, store, cache, and transmit your inputs and outputs strictly for the purpose of operating, rendering, displaying, and backing up your workspace assets.
• ArtShadown Proprietary Rights: The platform design, logo, UI/UX aesthetics, underlying source code, front-end software, and brand assets remain the exclusive intellectual property of ArtShadown.

5. Acceptable Use Policy & Prohibited Conduct

To ensure a safe, legally compliant, and creative environment for all users, you agree not to submit prompts, upload assets, or use the Services to:

• Generate illegal, harmful, sexually explicit, abusive, or violently graphic content.
• Synthesize non-consensual deepfakes, unauthorized depictions, or adult visual media targeting real individuals.
• Infringe upon third-party copyrights, trademarks, patents, or trade secrets.
• Deploy automated bots, scrapers, or reverse-engineering tools to harvest proprietary AI models, neural weights, or platform APIs.
• Launch Denial of Service (DDoS) attacks, upload malicious code, or compromise the integrity of our GPU server clusters.

Violation of this Acceptable Use Policy will result in immediate termination of access, revocation of unused credits or VIP memberships without refund, and potential referral to law enforcement agencies.

6. Disclaimer of Warranties

ARTSHADOWN IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, completely secure, or that generated visuals will meet your specific aesthetic or commercial expectations.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARTSHADOWN, ITS DEVELOPERS, DIRECTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES LOSS OF PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR INTELLECTUAL PROPERTY DISPUTES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM OR GENERATED MEDIA.

8. Modifications to Service & Terms

We reserve the right to revise or discontinue any feature, rendering tool, or model tier of the Services at any time. We may also update these Terms periodically. Continued use of ArtShadown following the posting of revised Terms signifies your acceptance of the changes.

9. Governing Law & Severability

These Terms shall be governed by and construed in accordance with the applicable laws of the operating jurisdiction, without giving effect to conflict of law principles. If any provision of these Terms is deemed unlawful or unenforceable, that provision shall be severable without affecting the validity and enforceability of remaining provisions.
